- Introduction
- 1.1. By using the Music Teacher Directory, you accept these terms and conditions in full in addition to our terms of website use; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use the Music Teacher Directory.

- 1.3. You must be at least 18 years of age to use our website; by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.
- 1.4. The Music Teacher Directory is to be used for the purpose of searching music teachers with experience of teaching pupils with vision impairments in England, Wales, Scotland, and Northern Ireland.
- 1.5. This directory only includes music teachers who are teaching children and young people in receipt of an Amber Trust Music Award, who have consented to their information being shared.
- 1.6. Music teachers who are teaching pupils in receipt of an Amber Trust Music Award are not employed by the charity. The Amber Trust takes no responsibility for teachers approached or engaged using this facility.
- 1.7. Although The Amber Trust has carried out our own safeguarding checks on all of the teachers listed, by using the Directory, you agree to carry out your own checks before engaging the services of a teacher to check that the teacher has the appropriate skills to teach the individual learner in your particular context.
- 1.8. It is your responsibility to ask teachers for evidence of their Enhanced Disclosure and Barring Service certificate (England and Wales), PVG certificate (Scotland) or Enhanced AccessNI certificate (Northern Ireland). In addition, you should ask for evidence of Safeguarding knowledge/training and Public Liability Insurance.
- 1.9. If you are looking for someone to teach an adult who is blind or partially sighted, you are welcome to this directory too - but please note that some of the teachers listed may have no experience of teaching adults and may not have knowledge and understanding of Safeguarding in relation to adults.
- 1.10. If you choose to engage a teacher listed in this directory you take full responsibility for that engagement. The Amber Trust and the funders of this directory (RNIB and Arts Council England) take no responsibility for the quality or suitability of services delivered by teachers listed in this directory.

- Misuse of the Music Teacher Directory
- You must not use this directory:
- 3.1. in any way or take any action that causes, or may cause, damage to the website or impairment of the performance, availability, accessibility, integrity or security of the website.
- 3.2. in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
- 3.3. for the purpose of harming or attempting to harm minors in any way;
- 3.4. to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
- 3.5. reproduce, republish, duplicate, copy or otherwise make publicly available any part of the Music Teacher Directory in contravention of the provisions of our terms and conditions or privacy policy.
- 3.6. for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing);
- 3.7. do anything that interferes with the normal use of our website.
- Cancellation and suspension of music teachers listed on the directory
- 4.1. We may:
- (a) suspend your account;
- (b) cancel your account; and/or
- (c) edit your account details,
- 4.2. We will usually cancel an account if the music teacher is no longer registered with The Amber Trust.

- 5.1. We do not warrant or represent:
- (a) The completeness, timeliness, accuracy, reliability, suitability, or availability of the information on the Music Teacher Directory and any content.
- (b) that the material on the Music Teacher Directory is up to date;
- (c) that the Music Teacher Directory will operate without fault; or
- (d) that the Music Teacher Directory will remain available.
- 5.2. The Amber Trust is under no obligation to oversee, monitor or moderate the use of the Music Teacher Directory.
- 5.1. We do not warrant or represent:
Limitations and exclusions of liability
Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and exclusions of liability set out in this Section and elsewhere in these terms and conditions (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the terms and conditions or in relation to the subject matter of the terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
To the extent that the Music Teacher Directory and the information are provided free-of-charge, we will not be liable for any loss or damage of any nature. The Amber Trust is not responsible for the nature, content and availability of any of the websites for whom links are provided. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them. The Amber Trust accepts no responsibility for the consequences of any transactions made or contracts entered into as a result of third party advertising on the Directory.
We reserve the right to discontinue or alter any or all of our website services, and to stop publishing our website, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if we stop publishing the website.
We may revise these terms and conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.
